Terms and Conditions
Terms and Conditions of Service
Ripton Community Broadband Inc.
Effective Date: October 14, 2026
1. Agreement and Scope
These Terms and Conditions of Service ("Terms") govern broadband internet services ("Services") provided by Ripton Community Broadband Inc. ("Ripton," "Company," "we," "us," or "our") to the person or organization subscribing to the Services ("Customer," "you," or "your").
By ordering, activating, or using the Services, you agree to these Terms, the applicable service plan and order information, and our Acceptable Use Policy (AUP), which is incorporated by reference. Our Privacy Policy describes our information practices.
2. Service Overview and Availability
Ripton provides fixed wireless broadband internet service using radio signals between network infrastructure and receiving equipment at the service address. Some service arrangements may involve additional network facilities or equipment.
Service is available only where Ripton determines that installation and performance are feasible.
Availability, speeds, and reliability may be affected by radio signal quality, line of sight, obstructions, weather, terrain, interference, network congestion, equipment, and other conditions.
3. Installation and Access
You authorize reasonable access to the service premises, with appropriate coordination, for installation, inspection, maintenance, replacement, and removal of Ripton-owned equipment.
You represent that you have authority to authorize the installation or will obtain permission from the property owner or other appropriate party.
Installation details and any applicable charges will be disclosed in the applicable service order or plan materials.
4. Equipment
Unless expressly stated otherwise in writing, equipment supplied by Ripton remains Ripton property.
You must use reasonable care, avoid unauthorized tampering or relocation, and make equipment available for removal or return when service ends.
Any charges for damaged, lost, or unreturned equipment must be disclosed in applicable service documents.
Customer-owned routers and network equipment may not be substituted for Ripton-provided equipment without prior written authorization.
5. Service Speeds, Performance, and Outages
Advertised speeds are "up to" speeds and are not guaranteed at every moment.
Actual experience can vary due to the factors described above and customer devices or in-premises conditions.
We do not guarantee uninterrupted or error-free service. We may perform planned maintenance and respond to unplanned outages and will make reasonable efforts to restore service.
The applicable broadband consumer label and publicly available service disclosures provide additional information about available plans, charges, performance, and network management.
6. Acceptable Use and Network Management
You agree to follow our Acceptable Use Policy, including restrictions on unlawful activity, spam, malicious software, unauthorized access, and disruption of the network or other users.
Ripton may use reasonable network-management and security practices described in the AUP and our public disclosures.
Material AUP violations may result in action under Section 10.
7. Plans, Billing, and Payment
Unless otherwise agreed in writing, service is billed monthly in advance.
Payment is due on the date indicated on your invoice.
A late fee may be assessed on payments not received within 15 days after the due date, but only if the amount and conditions are disclosed to you and permitted by applicable law.
Nonpayment may lead to service suspension or termination as permitted by law and these Terms.
Plan pricing, fees, discounts, taxes, payment-method conditions, and any promotional terms are governed by the applicable service order, current plan disclosures, and broadband consumer label.
8. Data Usage and Plan Restrictions
Where offered, an unlimited plan does not by itself prohibit normal high-bandwidth activities.
Ripton may take reasonable, disclosed measures to address network congestion or harmful activity consistent with applicable law and our AUP.
9. Optional Services and Emergency Calling
Any optional services, including managed Wi-Fi, streaming-related offerings, or voice services, are subject to their applicable descriptions and agreements.
Internet-based voice service, if separately offered, may not work during a power or internet outage.
Customers should maintain an alternative way to contact emergency services where appropriate.
This section does not mean that Ripton currently provides telephone or VoIP service.
10. Suspension and Termination
You may cancel service by providing 30 days' notice, subject to any different requirements of applicable law or an agreed written offer.
Ripton may suspend or terminate service for nonpayment, material breach of these Terms or the AUP, unlawful conduct, or network abuse.
When reasonably practical and appropriate, we will provide notice and an opportunity to correct a violation before non-emergency enforcement; immediate action may be needed to protect service or network security.
On termination, outstanding amounts remain due and Ripton-owned equipment must be returned or made available for retrieval.
Applicable equipment charges may be assessed as disclosed in your service documents.
11. Liability and Service Disclaimers
To the extent permitted by applicable law, Ripton will not be liable for indirect, incidental, special, or consequential damages related to use of, or inability to use, the Services.
To the extent permitted by law, Ripton's aggregate liability for a claim arising from the Services will not exceed the amount you paid for Services during the preceding month.
Nothing in these Terms limits liability or consumer rights that cannot legally be limited or waived.
12. Privacy
Our Privacy Policy explains the categories of personal and technical information we collect, how we use and share it, and the choices available to customers.
Our AUP provides additional detail about technical network monitoring related to safety, security, and abuse prevention.
13. Regulatory Disclosures
Ripton seeks to comply with applicable federal and Connecticut broadband requirements, including transparency obligations concerning network management practices, service performance, commercial terms, and broadband consumer labels.
Current broadband plan disclosures, including consumer labels, should be made available at the point of sale and on our website as required by law.
Any Lifeline or other subsidy participation, if offered, will be communicated separately with current eligibility information.
14. Updates to These Terms
We may revise these Terms periodically.
Updated Terms will be posted with a revised effective date, and additional notice will be provided when required by law or an applicable agreement.
Changes will apply prospectively to the extent required by law.
Continued use after an applicable change may constitute acceptance to the extent permitted by law.
